This introductory chapter outlines the history of the recognition of women’s rights in international law since 1945. In particular, it examines the international negotiations which were carried out before the adoption of the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW, 1979) and its Optional Protocol (1999). It highlights the disagreements between States and the ensuing compromises, which is reflected in the contents of the texts. Moreover, the article addresses the shortcomings of the Convention and its Protocol, in particular the lack of recognition of the right of women to free development and the increasing number of reservations justified by religious reasons. Indeed, according to these reservations a State would ratify the Convention whilst declaring that it will only be applied so far as the divine teachings would allow it.
Ce chapitre introductif retrace l’histoire de la consécration des droits des femmes en droit international depuis 1945. Il étudie notamment les négociations internationales précédant l’adoption de la Convention pour l’élimination des discriminations à l’égard des femmes (CEDEF, 1979) et de son Protocole facultatif (1999). Il met en avant les désaccords interétatiques et les compromis, qui expliquent le contenu des deux textes. Il évoque également les lacunes de la Convention et de son Protocole, et notamment l’absence de consécration d’un droit des femmes au libre épanouissement et la multiplication des réserves religieuses, qui permettent à un État de ratifier la Convention tout en déclarant qu’elle ne s’appliquera que dans la limite des prescriptions divines.
