Methods of legal interpretation, their limits and consequences for the research
Los métodos de interpretación, sus límites y consecuencias para la investigación
Résumé
The function of legal interpretation is to make sense of propositions written on legal texts. Since a long time, lawyers and academics tried to define pertinent methods in order to make clear and to determine the sense of legal propositions. Each method has their own presumptions but also limits. After the identification of them, it will be suggested the consequences for the legal research.
La interpretación jurídica consiste en dar sentido a los enunciados que componen los textos legales. Los juristas han intentado desde hace mucho tiempo identificar métodos de interpretación adecuados para aclarar y fijar el sentido de los enunciados jurídicos. Sin embargo, cada uno presenta sus propios presupuestos, obstáculos y limitaciones. Después de haberlos identificado, subrayaremos las consecuencias que resultan para la investigación jurídica.
