L'Etat de droit
Résumé
In this article, the author makes a critique of the commonly held opinion according to which the notion of "Estado de derecho" is a guarantee of democracy and human rights. In his analysis, he examines the relation between such notion and the concept of democracy. He makes a historical review of the concept of "Estado de derecho" and analyses the different meanings of the concept of democracy, as well as its links with the concept of sovereignty. In the author's opinion, the reference to the "Estado de derecho" has hidden the fact that the essential matter is in the political definition of democracy, which is the real power behind the State.
L'objet de ce papier est de rappeler l'existence de quelques pistes disponibles pour une analyse critique de l'affirmation, désormais communément admise, qui fait de l'Etat de droit la garantie de la démocratie et des droits de l'Homme. Cette affirmation ne génère pas de signification précise, sans que cela soit forcément étonnant : même dans le discours juridique, auquel il est apparemment emprunté et renvoie, le concept d'Etat de droit est appréhendé principalement comme modèle prescriptif d'organisation sociale, sans que l'on puisse pour autant avec certitude désigner un modèle existant dont il rendrait compte, ni un modèle politique unique auquel il serait attaché.
