Sentiments et droits de l’homme
Abstract
Integrated in the European Court of Human Rights’ control, the taking into consideration of feelings needs to be examined. Feeling constitutes a common characteristic of humanity, arising from an assessment based on objective circumstances, like that operated by Adam Smith’s « impartial spectator ». The status analysis of feelings in case-law extends itself through the determination of the place reserved to feelings.
Intégrée au contrôle de la Cour européenne des droits de l’homme, la prise en considération des sentiments requiert d’être analysée. Le sentiment constitue une dimension de l’humanité commune, relevant d’une évaluation menée en fonction de circonstances objectives, à l’instar de celle opérée par le « spectateur impartial » d’Adam Smith. L’analyse du statut du sentiment dans la jurisprudence se prolonge par la détermination de la place accordée aux sentiments.
