Juge judiciaire, acteur de l'essor de l'arbitrage

Abstract : Through his support and regulation, the State judge has a crucial role in the arbitral proceedings and in arbitration in general. The development of arbitration lays on two aspects in which the judge intervenes. First, he contributes to the construction of the arbitration law through the clarification of the law, the necessary interpretations, or by filling in the gaps in the texts. Secondly, he contributes to the development of arbitration by becoming the guarantor of an effective procedure in accordance with the rules and principles of arbitration.
