Les identités saisies par le droit : quelles identités ? quelle protection ?

Abstract : Identities are made of individual characteristics but also of collective features linked to belonging to a group – be it religious, ethnic, linguistic, cultural, etc. – especially when the group is considered a minority within society. How does the law deal with these multifaceted identities, what protection does it provide? There is a striking contrast between, on the one hand, the raise in identity claims and the growing echo they receive at the international level, and, on the other hand, the generally non-binding nature of the resulting provisions. One may therefore wonder on what basis and in what terms judges rule on disputes arising from these identity quests.
