Le "contrôle abstrait" de constitutionnalité comme obstacle à l'identification des discriminations

Abstract : The French Constitutional Council is supposed to interpret statutes only in abstracto. The purpose of this paper is to argue that the distinction between in abstracto and in concreto interpretations is used to justify Judicial Self-Restraint. Pretending that the constitutional judge should not look at the way the statute is enforced, the Constitutional Council refuses to identify discriminatory situations. Therefore, that argument usually allows the Constitutional Council to validate a discriminatory statute.
